These Website Terms and Conditions (“Terms”) govern access to and use of 10/10llc.net (the “Website”), operated by 10/10 Construction, LLC. (“10/10 Construction,” “we,” “us,” or “our”). By accessing or using the Website, submitting a form, or enrolling in our text-messaging program, you agree to these Terms. If you do not agree, do not use the Website.
1. Website Purpose and Eligibility
The Website provides general information about our construction-related services and allows users to request information, estimates, appointments, or communications. You must be at least 18 years old and legally capable of entering into an agreement to use the Website for business transactions.
2. No Contract or Guaranteed Estimate
Website content, online forms, preliminary discussions, and requests for estimates do not create a construction contract, guarantee availability, reserve a project date, or obligate us to perform work. Any estimate, proposal, scope, price, schedule, warranty, or other project term is effective only as stated in a separate written agreement issued or accepted by 10/10 Construction. Conditions concealed from ordinary observation, changes in material or labor costs, code requirements, permit conditions, owner selections, and changes in scope may affect pricing and scheduling.
3. Acceptable Use
You agree not to misuse the Website. Prohibited conduct includes attempting unauthorized access; introducing malware; interfering with Website operation; scraping or copying content through automated means without permission; impersonating another person; submitting false, unlawful, defamatory, or infringing material; or using the Website in violation of law.
4. User Submissions
When you submit photographs, plans, descriptions, reviews, messages, or other content, you represent that you have the right to provide it and that it does not violate law or third-party rights. You grant us a nonexclusive, worldwide, royalty-free license to use, copy, store, transmit, and display the submission as reasonably necessary to respond to your request, evaluate or perform services, maintain records, resolve disputes, and operate our business. We will handle personal information as described in our Privacy Policy.
5. Intellectual Property
The Website and its text, graphics, logos, photographs, videos, design, software, and other content are owned by or licensed to 10/10 Construction and are protected by intellectual-property laws. You may view and print reasonable portions for personal, noncommercial use. No other reproduction, distribution, modification, republication, framing, or commercial use is permitted without prior written consent.

Links to third-party websites or services are provided for convenience only. We do not control or endorse third-party content and are not responsible for its availability, accuracy, security, terms, or privacy practices. Your use of third-party services is governed by the third party’s terms.
7. Text Messaging Terms
By affirmatively opting in, you authorize 10/10 Construction to send text messages to the mobile number you provide. Messages may include appointment reminders, estimate follow-ups, project updates, service notifications, account or customer-service communications, and promotional offers when you have consented to marketing. Message frequency varies. Message and data rates may apply. Consent to receive marketing texts is not a condition of purchasing goods or services.
Opt-Out and Help
Reply STOP to any message to unsubscribe. You may also use other reasonable language clearly communicating that you want messages to stop. After opting out, you may receive one final confirmation message. Reply HELP for assistance or contact us through 10/10llc.net or at the mailing address below. Carriers are not liable for delayed or undelivered messages.
Eligibility and Number Changes
You represent that you are the subscriber or customary user of the mobile number provided and are authorized to consent to messages at that number. You agree to promptly notify us if your number changes or is reassigned. Text-messaging consent and opt-in records will be maintained as required for program operation and legal compliance.
Privacy of Mobile Information
No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with third parties, except vendors assisting with the messaging program under appropriate restrictions or as required by law. 8. Disclaimers
THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. WEBSITE CONTENT IS GENERAL INFORMATION AND IS NOT ENGINEERING, ARCHITECTURAL, LEGAL, INSURANCE, TAX, OR OTHER PROFESSIONAL ADVICE. PROJECT-SPECIFIC DECISIONS SHOULD BE BASED ON AN INSPECTION AND THE APPLICABLE WRITTEN AGREEMENTS AND PROFESSIONAL ADVICE.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, 10/10 CONSTRUCTION AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION ARISING FROM WEBSITE USE. OUR TOTAL LIABILITY FOR A CLAIM ARISING SOLELY FROM USE OF THE WEBSITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). THESE LIMITATIONS DO NOT ALTER LIABILITY OR REMEDIES EXPRESSLY PROVIDED IN A SEPARATE CONSTRUCTION CONTRACT AND DO NOT APPLY WHERE PROHIBITED BY LAW.
10. Indemnification
You agree to defend, indemnify, and hold harmless 10/10 Construction and its owners, officers, employees, and agents from claims, losses, liabilities, costs, and reasonable attorneys’ fees arising from your unlawful misuse of the Website, your violation of these Terms, or content you submit that infringes third-party rights. This provision does not apply to the extent a claim results from our own unlawful conduct.
11. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Subject to any enforceable dispute-resolution provision in a separate written agreement, exclusive venue for disputes arising solely from these Terms or Website use will lie in the state courts located in Tarrant County, Texas, or the applicable federal court serving Tarrant County. You waive objections to personal jurisdiction and venue in those courts to the extent permitted by law.
12. Changes, Suspension, and Termination
We may modify the Website or these Terms at any time. Updated Terms become effective when posted with a revised effective date, unless a later date is stated. We may suspend or terminate Website access for misuse, security concerns, legal compliance, or business reasons.
13. General Provisions
If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any applicable written project agreement, constitute the relevant agreement concerning Website use. A project contract controls over these Terms if there is a direct conflict regarding construction services.
